Sobre
Seeking a licensed Brazilian OAB attorney to file and enforce a U.S. child support judgment through STJ homologation and a new ação de alimentos. Verified income, family data, and official records provided. Results-based milestones; enforcement paid via court-awarded sucumbência. Client: U.S.-based pro se petitioner Objective: Recognize and enforce a U.S. child-support judgment in Brazil through STJ homologation and full enforcement (ação de alimentos and execution). Case Overview The respondent is a dual Italian–Brazilian citizen residing in the U.S., his spouse is employed by a Brazilian company (verified household income ~USD 145 K/year). A U.S. family court judgment from 2016 (~USD 52 K) has accrued to ~USD 170 K+ in arrears, with a new order pending. Enforcement in Brazil will establish both: Recognition (STJ homologation) of the U.S. judgment, and Ongoing ação de alimentos extending support until both children complete college or become financially self-supporting. Scope of Work Retrieve and certify official Brazilian government and court documents (no translations or legal analysis). File the STJ homologation petition recognizing the U.S. judgment. File the Family Court ação de alimentos for ongoing and future support. Initiate and pursue enforcement actions under Brazilian law (bank/wage seizure, registration of arrears, property lien, etc.). Provide continuing verification of enforcement progress. Enforcement is mandatory and compensated only through court-awarded honorários de sucumbência (≈ 10 % of arrears and ongoing collections — estimated USD 17 K+ potential). Deliverables & Verification All deliverables must include official filings or verifiable court artifacts. All milestones must include verifiable protocol numbers and/or official docket links (STJ, TJSP, TJRJ, TJRN, etc.). Verification & Transparency Requirements Client must receive protocol/docket numbers for all filings. Attorney must upload copies of petitions and orders to Upwork. All filings must be traceable via official CNJ docket or certified extracts. Payments released only upon verified filings (Enforcement Verification Clause applies). Compensation Fixed project milestones: USD 1 000 – 1 400 total for documentation + filings. Enforcement: compensated via court-awarded sucumbência (≈ 10 %), not paid by client. Long-term potential: continuing sucumbência on future alimentos enforcement. Resources Provided LAI filing and response (cancelled CPF). Verified CPF/CNPJ data, Fogo de Chão payroll proof, property and registry extracts. U.S. tax returns, discovery exhibits, and judgment orders (under NDA). Italian citizenship documentation (if relevant). Requirements Active OAB license. Experience in STJ homologation, Family Court actions, and judgment enforcement. Ability to obtain and attest official records. Comfortable working with a pro se U.S. client (no translation or analysis required). NDA required before document access. Why This Project Matters This is a live, cross-border enforcement effort designed to secure educational and financial support for two nearly-adult children. All investigative groundwork is done — you’ll start with verified evidence, ready filings, and a clear legal path. Your success ensures the case achieves both social justice and professional recognition — with built-in compensation through sucumbência under Brazilian law. Application Instructions: If you are a licensed Brazilian attorney (OAB) with experience in homologação de sentença estrangeira and ação de alimentos, please submit your proposal including: (1) your full name and OAB registration number; (2) confirmation of your ability to retrieve official documents and file petitions with the STJ and Family Court; (3) a brief note on any prior enforcement or homologation cases you have handled; and (4) acknowledgment that all filings must be verifiable and that enforcement compensation will be through court-awarded sucumbência only. No analysis or translation work is required — document retrieval, attestation, and filing only.
